STANDARD TERMS & CONDITIONS OF SERVICE
1. Where the client extends an offer of employment whether permanent, temporary, limited duration contract, or fixed term contract to a candidate in any capacity referred to the client by The Ideal Crew, such offer shall be deemed to be an acceptance of The Ideal Crew’s Standard Terms and Conditions of Service in its entirety, and which shall be binding on the client for a period not exceeding twelve (12) months.
2. 50% of the full fee is payable by the client on receipt of an invoice before “The Ideal Crew” initiates the recruitment process (for advertising fees) and the balance must be received by “The Ideal Crew” no later than three (3) working days from the date the employee signs the offer of employment, in order for the client to qualify for the guarantee as set out herein.
3. The Client undertakes to treat all information concerning the candidate in strict confidence and further to refrain from contacting the candidate’s current employer for whatever reason, without the candidate’s prior written approval.
4. An introduction of a candidate can be made telephonically, verbally, electronically or in writing. The introduction, which is valid for a twelve (12) month period, is relevant should a candidate commence employment in any capacity or position. These terms and conditions will apply irrespective of whether the employment arrangement is for permanent or temporary employment or limited duration or fixed-term contract.
5. Should the Client defer the decision to employ a candidate introduced by The Ideal Crew and subsequently thereto the client employs the candidate within twelve (12) months of that introduction, then The Ideal Crew is entitled to the full fee. Should the candidate be re-introduced to that organisation for another position within the original twelve (12) month introduction period, it will be deemed as a new introduction with the twelve (12) month introduction period effective from the date of the subsequent introduction.
6. No alterations or amendments to these Standard Terms & Conditions of Service shall be contemplated unless agreed upon, reduced to writing and signed by both parties. This agreement supersedes any prior agreement concluded between the parties.
7. Additional fees
The CLIENT agrees and undertakes to make a payment of R400 per candidate in advance should any criminal, ITC or background checks be needed before an offer of employment can be made, whether the client chooses to place the candidate or not. The fee will be payable in respect of any CANDIDATE appointed in any capacity by the CLIENT within a period of 12 (TWELVE) months of the introduction by the ORGANISATION.
8. INTEREST: Interest will be charged on all overdue accounts at a rate equal to the prime rate at the time of indebtedness.
9. GUARANTEE: The guarantee is subject to the Guarantee being validated. The Guarantee is validated by the full placement fee being paid within 3 days of acceptance of offer of employment. Guarantees are not given for temporary employees of contracts shorter than three months.
Whilst every effort is made by “The Ideal Crew” to assist the Client in appointing the most suitable candidate, “The Ideal Crew” cannot warrant that the candidate will remain with the Client for any period of time.
10. WAIVER: “The Ideal Crew” endeavours to take all reasonable measures to ensure that the candidates referred meet Client requirements. However, the final decision to employ a candidate rests with the Client and “The Ideal Crew” will therefore not be held responsible or liable for any damages caused directly or indirectly by a candidate introduced by “The Ideal Crew”.
The Ideal Crew does not accept any liability for any information and/or representation made expressly or implied by a candidate introduced to a Client which representation proves to be untrue, unfounded or inaccurate.
11. LEGAL COSTS: In the event whereby the client does not make payment of the placement fee as set out herein or is otherwise in breach of the Terms and Conditions contained herein and The Ideal Crew institutes or commences action against the client, the client will be liable to pay costs of The Ideal Crew on an attorney and client scale, including but not limited to Sheriff’s costs, tracing costs, advocates costs, collection of commission, etc.
Client’s Informed Consent:
The Client has carefully read this Agreement and considered the additional information and advice that The Ideal Crew has provided to The Client. The Client understands the possible risks and benefits of the service representation described in this Agreement. Understanding those possible risks and benefits, The Client voluntarily, knowingly and intentionally enters into this Agreement with The Ideal Crew.
